評述 Remarks 原創文學作品 Original literary works 任何寫出、講出或唱出的作品，包括電腦程式 Any work which is written, spoken or sung , including computer program 2. 原創戲劇作品Original dramatic works 包括舞蹈作品或默劇作品 Including works of dance or mime 3. 原創藝術作品Original artistic works 包括相片、雕塑品、建築作品及美術工藝作品 Including photographs, sculptures, works of architecture and works of artistic craftsmanship 4. 原創音樂作品Original musical works 由音樂構成的作品，但不包括隨音樂唱出或講出的文字 It means a work consisting of music, excluding words sung or spoken with the music Intellectual Property Department, Hong Kong SAR Government

必須符合以下條件︰ The following conditions must be complied with : (a) 基本考慮因素 Primary consideration 沒有抵觸版權人正常利用作品及亦不損害其合法權益 Does not conflict with normal exploitation of work nor prejudice legitimate interest of copyright owner Intellectual Property Department, Hong Kong SAR Government

沒有有關版權擁有人的特許下 Without the licence of copyright owner 製作，輸入，輸出，分發，為任何貿易或業務的目的管有 / 出要約出售或出租 Make, import, export, distribute, or possess/offer for sale on line for the purpose of, in the course of, or in connection with trade and business 侵權品，或用作或擬用作製作侵權品 Infringing copy or article used or intended to use to make infringing copies Intellectual Property Department, Hong Kong SAR Government

23 刑事責任 (三) Criminal Liability (3)
刑罰 Penalty : 經營任何版權作品侵權複製品︰罰款 HK$50,000（每件侵權物）及監禁4年 Dealing with infringing copies of any copyright works : fine HK$50,000 (each infringing copy) and 4 years’ imprisonment 經營或管有特定為製作某版權作品的侵權複製品而設計或改裝之物品︰罰款HK$500,000及監禁8年 Dealing with or possessing an article specifically designed or adapted for making copies of a copyright work : fine HK$500,000 and 8 years’ imprisonment Intellectual Property Department, Hong Kong SAR Government

若法人團體或合夥機構的作為引致業務最終使用者刑責 If a body corporate or a partnership has done an act attracting business end-user criminal liability 除非有證據證明董事/合夥人沒有授權任何人作出有關侵權作為 Unless evidence showing director(s) / partner(s) has not authorized the infringing act to be done 擬議刑責只涵蓋負責機構內部管理的董事、合夥人或人士 The scope of the proposed criminal liability covers only those directors, partners or persons that are responsible for the internal management of the organisation Intellectual Property Department, Hong Kong SAR Government

appoint a compliance officer or an officer responsible for managing software assets to oversee and to act as a focal point for matters related to SAM and intellectual property (b) 公布有關適當管理和使用電腦軟件的內部指示，以確保每名人員均了解各項要求 promulgate internal instructions in respect of the proper management and use of computer software to ensure that each staff member clearly understands the requirements (c) 確保所有人員均知道只可使用已獲授權的軟件 ensure general awareness of all staff members to use only authorised software Intellectual Property Department, Hong Kong SAR Government

38 背景 Background 「商業軟件認證計劃」為去年九月推出之「商業軟件『正』行動」的第二期其中一項試驗計劃。
Business Software Certification Programme is one of pilot programmes under the second phase of Genuine Business Software Campaign (GBSC) which has been launched in September last year. 計劃目的為進一步協助機構，無論是商業或非商業，以獲取正確的商業軟件資產管理知識及鼓勵企業及機構使用合法商業軟件。 The aim to further equip organisations, both business and non-business, with a good knowledge of Software Asset Management (SAM) and to promote proper licensing of business software. 42 到訪軟件核實服務 On-Site Software Audit Service
獨立的軟件資產管理承辦商: 知識產權署透過委託一個獨立的承辦商為參與機構提供免費的軟件核實及軟件資產管理顧問服務。 Independent Software Asset Management Contractor: Under the Programme, an independent Contractor will be commissioned to provide Free Software Audit and Software Asset Management Consultancy Services to participating organisations. 保密聲明: 承辦商將與參與機構簽署保密聲明，以確保參與機構的軟件核實資料受保密，不會外洩予第三者 。 Non-disclosure Agreement : The Contractor will enter into a Non-disclosure Agreement with participating organisations. It ensures that the information relating to the software licensing situation collected during the on-site software audit would not be disclosed to any third party. 43 成功完成計劃後…… What if Participants Complete the Programme successfully…….
主辦機構會向完全符合「商業軟件認證計劃」標準的參與企業及機構頒發證明書。 同時亦會透過報紙及網址等一連串的宣傳媒體高度表揚完成通過軟件核實的企業及機構。 Organisers will issue a Certificate to commend those organisations found in full compliance.
