2 土地使用权 (Land Use Right) 土地使用权（Land Use Rights）是指国家机关、企事业单位、农民集体和公民个人，以及三资企业，凡具备法定条件者，依照法定程序或依约定对国有土地或农民集体土地所享有的占有、利用、收益和有限处分的权利。

4 土地使用类型 – 1. 土地划拨（land allocation）
（1）批准  缴纳补偿、安置等费  取得国有土地使用权 (permission  pay expenses  access to land use rights) （2）批准  取得国有土地使用权 (无须缴纳任何费用、支付任何经济上的代价) (permission  access to land use rights (no expenses required)) （3）划拨土地使用权一般不得转让、出租、抵押 (no assignment, rent out or mortgage) Resources:《土地管理法》和《土地登记办法》

5 2. 出让土地使用权 （selling the land）
（1）支付土地使用权出让金  取得一定年限内的土地使用权 (pay expenses  access to land use rights in a certain period of year) （2）土地使用权有期限的（由合同签订） 但不得超过法律限定的最高年限。(land use rights is limited) （3）其使用权在使用年限内可以依法转让、出租、抵押或者用于其他经济活动 (assignment, rent out or mortgage is allowed) 来源《土地管理法》和《土地登记办法》

6 什么是使用期限？(Life of land use rights)
住宅用地使用权最长为70年 (Residential land use rights up to 70 years) 工业及科教文卫等最长期限为50年 (industrial & Educational land use rights up to 50 years) 商业、旅游、娱乐最长期限为40年 (Commercial/Travel/Media land use rights up to 40 years)

7 住房补贴 (housing allowance)
对职工因未享受国家福利分房(welfare-oriented distribution (allocation) of public housing) 政策，或虽已享受国家福利分房但 未达规定面积标准的，单位按国家或地方政府规定的补贴标准， 一次性或按月计入职工个人所在的住房公积金管理中心专用账 户的住房补贴，暂不征收个人所得税（Individual Income Tax）。

8 补贴对象 （beneficial owner)
职工：包括学校教师，军人，武警等 （including educators, police, soldier etc)

9 补贴形式（allowance types）
（1）一次性补贴方式（主要针对无房的老职工） （once-for-all-subsidy policy （mainly to elder staff who have no houses)) （2）基本补贴加一次性补贴方式（按一般职工住房面积标准，逐步发放 基本补贴）(gradually pay) （3）按月补贴方式（主要针对新职工，在住房补贴发放年限内，按月计 发）(monthly pay (mainly to new staff))

10 限购令 （housing restriction policy)
2010年4月30日北京出台“国十条实施细则”中明确提出的: 从5月1日起，北京家庭只能新购一套商品房，购房人在购买房屋时，还 需要如实填写一份《家庭成员情况申报表》，如果被发现提供虚假信息 骗购住房的，将不予办理房产证。这是全国首次提出的家庭购房套数“限 购令”。
